Welcome to Consultport, a service of Consultport GmbH (hereinafter “Consultport”, “we”, “our” or “us”). Your privacy is important to us. This Privacy Policy explains how we collect, store, use and disclose your personal information when you use consultport.com with all related websites and services provided. By using the website, our services and in particular by registering and creating a user account, you agree to the use of your data in the manner described in this privacy policy. As a responsible company, we avoid automatic decision making or profiling. Likewise, the terms used in the following are not gender-specific and you can save or print this privacy policy at any time via your browser.
Personal data (usually referred to just as “data” below) will only be processed by us to the extent necessary and for the purpose of providing a functional and user-friendly website, including its contents, and the services offered there. Per Art. 4 No. 1 of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as the “GDPR”), “processing” refers to any operation or set of operations such as collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment, or combination, restriction, erasure, or destruction performed on personal data, whether by automated means or not.
The following privacy policy is intended to inform you in particular about the type, scope, purpose, duration, and legal basis for the processing of such data either under our own control or in conjunction with others. We also inform you below about the third-party components we use to optimize our website and improve the user experience which may result in said third parties also processing data they collect and control.

II. The rights of users and data subjects
With regard to the data processing to be described in more detail below, users and data subjects have the right
- to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (cf. also Art. 15 GDPR);
- to correct or complete incorrect or incomplete data (cf. also Art. 16 GDPR);
- to the immediate deletion of data concerning them (cf. also Art. 17 DSGVO), or, alternatively, if further processing is necessary as stipulated in Art. 17 Para. 3 GDPR, to restrict said processing per Art. 18 GDPR;
- to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers (cf. also Art. 20 GDPR);
- to file complaints with the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions (see also Art. 77 GDPR).
In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Nevertheless, users have a right to information about these recipients.
Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller’s future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

III. What personal data is collected?
We collect data about you from multiple sources. This section serves as a summary of the most important ones, a complete list can be found under point VI (Information on data processing) of this privacy policy.
You do not have to provide us with any personal data to visit the platform. However, in order to use our platform and services, you must register on the platform and create a user account. Within the scope of this registration and use of the platform, you provide us with data, in particular
- Profile data: Your name, your address, your telephone number, your email address, birthday, consultant information on your CV, preferences regarding willingness to travel and mode of work
- Payment data of the consultants with explicit consent for the purpose of payment processing and tax number (“Payment Data”). These payment data are collected, stored and exclusively used by us for invoicing and payment processing. This data can be managed, changed or deleted within your user account at any time.
- Data from correspondence: If you contact us via an online form on the website or by email, fax or other offline means, you provide us with certain personal data.
- Data from surveys: If you participate in a survey, you provide us with certain personal data in your answer, unless you answer anonymously.
- Newsletter: If you would like to receive the newsletter offered on the platform, we need an email address from you as well as information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. You can revoke your consent to the storage of the data, the e-mail address as well as its use for sending the newsletter at any time, for example by using the “unsubscribe” link in the newsletter.
Our services available after successful registration are not offered to persons under the age of 18. We therefore do not intentionally collect personal information from visitors under the age of 18 if they register.
In accordance with our privacy policy, we collect certain data automatically as a result of your use of the platform or by using web analytics services. These data include:
- the IP address of the device from which you access the Platform (this may be used to determine the country or city from which you access the website)
- the Internet page you visited immediately before you visited the platform
- certain activities you engage in on the website, including the pages you visit
- connections with your LinkedIn, XING or Facebook account
- the timing, frequency and duration of your visits to the platform
- your browser type and version, language setting and operating system
- the type of device from which you access the Site, such as whether you are using a personal computer or a mobile device, and its device ID

We use this data only for evaluations for the purpose of operation, security and optimization of our offer. However, we reserve the right to check this data subsequently if there is a justified suspicion of illicit use based on concrete evidence.
IV. What do we use your data for?
The information you provide will be used for the purposes of providing a functional website and performing the services of Consultport. In addition, the user information and profile data we collect will only be used or published to the extent described in our terms and conditions and/or this privacy policy.
We use the data collected about you either to provide our services, to answer your enquiries or to help us improve our services. Your data is used as follows:
- to operate your user account and to provide you with access to the website and use of the services you have requested, using your email address and password for identification purposes when you register on the website
- to share your profile data with the client for whom you want to work on a project (only after you have actively applied for a project)
- to analyze the use of the website and the people who visit the website and use the services in order to improve the design and services of Consultport and to adapt them to the needs of the interested parties
- to answer your questions after contacting us
- to make occasional telephone calls with you regarding topics related to our service offerings or to receive feedback from you
- to send you administrative email messages such as security, support or maintenance emails
- to send emails with content related to our services to registered users, unless the user has objected to this
- to ask about your participation in surveys, to carry out these surveys and to evaluate the results of these surveys, if you participate
- to prevent or take action against activities that violate or may violate our terms of use or applicable law
- to prevent (unauthorised) users from registering again
- for age limits
V. Security of your data
We use the latest security technologies to protect your information from unauthorized access, use or disclosure. For sensitive information, we use Secure Sockets Layer Technology (SSL) encryption technology. You can recognise an encrypted connection by the fact that the address line of your browser changes from “http://” to “https://” and by the lock symbol in your browser line. If SSL encryption is activated, the data that you transmit to us cannot be read by third parties. Despite the security measures we apply, transmission via the Internet or electronic storage methods are never 100% secure. However, we always aim to take the latest security measures to protect your data.
VI. Information about the data processing
Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.
1. Server data
For technical reasons, the following data sent by your internet browser to us or to our server provider will be collected, especially to ensure a secure and stable website: These server log files record the type and version of your browser, operating system, the website from which you came (referrer URL), the webpages on our site visited, the date and time of your visit, as well as the IP address from which you visited our site.
The data thus collected will be temporarily stored, but not in association with any other of your data. The basis for this storage is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website. The data will be deleted within no more than seven days, unless continued storage is required for evidentiary purposes. In which case, all or part of the data will be excluded from deletion until the investigation of the relevant incident is finally resolved.

3. Customer account/registration
If you create a customer account with us via our website, we will use the data you entered during registration (e.g. your name, your address, or your email address) exclusively for services leading up to your potential placement of an order or entering some other contractual relationship with us, to fulfill such orders or contracts, and to provide customer care (e.g. to provide you with an overview of your previous orders or to be able to offer you a wishlist function). We also store your IP address and the date and time of your registration. This data will not be transferred to third parties.
During the registration process, your consent will be obtained for this processing of your data, with reference made to this privacy policy. The data collected by us will be used exclusively to provide your customer account. If you give your consent to this processing, Art. 6 Para. 1 lit. a) GDPR is the legal basis for this processing.
If the opening of the customer account is also intended to lead to the initiation of a contractual relationship with us or to fulfill an existing contract with us, the legal basis for this processing is also Art. 6 Para. 1 lit. b) GDPR. You may revoke your prior consent to the processing of your personal data at any time under Art. 7 Para. 3 GDPR with future effect. All you have to do is inform us that you are revoking your consent. The data previously collected will then be deleted as soon as processing is no longer necessary. However, we must observe any retention periods required under tax and commercial law.
4. Contact
If you contact us via email or the contact form, the data you provide will be used for the purpose of processing your request. We must have this data in order to process and answer your inquiry; otherwise we will not be able to answer it in full or at all. The legal basis for this data processing is Art. 6 Para. 1 lit. b) GDPR.
Your data will be deleted once we have fully answered your inquiry and there is no further legal obligation to store your data, such as if an order or contract resulted therefrom.
5. Online job applications / publication of job advertisements
We offer you the opportunity to apply for jobs with our company via our website. In the case of these digital applications, we collect your application data electronically in order to process your application. The legal basis for this processing is §26 Para. 1 S. 1 BDSG in conjunction with Art. 88 Para. 1 GDPR.
If you are hired as a result of the application process, we will store the data you provide during the application process in your personnel file for the purpose of the usual organizational and administrative process, naturally in compliance with further legal obligations. The legal basis for this processing is §26 Para. 1 S. 1 BDSG in conjunction with Art. 88 Para. 1 GDPR.
If we do not hire you, we will automatically delete the data submitted to us two months after the final decision is made. We will not delete the data, however, if we must store the data for legal reasons such as evidence of equal treatment of applicants, until any legal action is concluded, or four months. In this case, the legal basis is Art. 6 Para. 1 lit. f) GDPR and §24 Para. 1 No. 2 BDSG. Our legitimate interest lies in any legal defense we may have to mount.
If you expressly consent to a longer storage of your data, e.g. for your inclusion in a database of applicants or interested parties, the data will be processed further on the basis of your consent. The legal basis is then Art. 6 Para. 1 lit. a) GDPR. You may withdraw your consent at any time with future effect per Art. 7 Para. 3 GDPR with future effect.
6. Social media links via graphics
We also integrate the following social media sites into our website. The integration takes place via a linked graphic of the respective site. The use of these graphics stored on our own servers prevents the automatic connection to the servers of these networks for their display. Only by clicking on the corresponding graphic will you be forwarded to the service of the respective social network. Once you click, that network may record information about you and your visit to our site. It cannot be ruled out that such data will be processed in the United States.
Initially, this data includes such things as your IP address, the date and time of your visit, and the page visited. If you are logged into your user account on that network, however, the network operator might assign the information collected about your visit to our site to your personal account. If you interact by clicking Like, Share, etc., this information can be stored your personal user account and possibly posted on the respective network. Our legitimate interest lies in the analysis, communication, sales, and promotion of our products and services. The legal basis may also be your consent per Art. 6 para. 1 lit. a GDPR granted to the platform operator. Per Art. 7 para. 3 GDPR, you may revoke this consent with the platform operator at any time with future effect. When accessing our online presence on the Facebook platform, Facebook Ireland Ltd. as the operator of the platform in the EU will process your data (e.g. personal information, IP address, etc.).
This data of the user is used for statistical information on the use of our company presence on Facebook. Facebook Ireland Ltd. uses this data for market research and advertising purposes as well as for the creation of user profiles. Based on these profiles, Facebook Ireland Ltd. can provide advertising both within and outside of Facebook based on your interests. 7. Statistical and analytical tools + other media
Google Analytics
We use Google Analytics on our website. This is a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland (hereinafter: Google). Through certification according to the EU-US Privacy Shield https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active Google guarantees that it will follow the EU’s data protection regulations when processing data in the United States.
The Google Analytics service is used to analyze how our website is used. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our site. Usage and user-related information, such as IP address, place, time, or frequency of your visits to our website will be transmitted to a Google server in the United States and stored there. However, we use Google Analytics with the so-called anonymization function, whereby Google truncates the IP address within the EU or the EEA before it is transmitted to the US.
The data collected in this way is in turn used by Google to provide us with an evaluation of visits to our website and what visitors do once there. This data can also be used to provide other services related to the use of our website and of the internet in general. Google states that it will not connect your IP address to other data. In addition, Google provides further information with regard to its data protection practices at https://www.google.com/intl/de/policies, including options you can exercise to prevent such use of your data.
In addition, Google offers an opt-out add-on at https://tools.google.com/dlpage/gaoptout?hl=en along with further information. This add-on can be installed on the most popular browsers and offers you further control over the data that Google collects when you visit our website. The add-on informs Google Analytics’ JavaScript (ga.js) that no information about the website visit should be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analytics services we may use as detailed herein.
Hotjar web analytics
We use Hotjar on our website. This is a web analytics service provided by Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe, hereinafter referred to as “Hotjar”. Hotjar is used to analyze how our website is used. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our site.
Hotjar allows us to monitor your usage behaviour on our website, such as logging and evaluating your mouse movements or mouse clicks. However, your visit to our website will be anonymized. In addition, information about your operating system, your internet browser, incoming or outgoing links, the geographical origin of your access, and the type and resolution of the device you are using are evaluated by Hotjar and processed for statistical purposes. In addition, you have the option of terminating the analysis of your usage behavior by opting out. Criteo web analytics
We use Criteo on our website for analytics and custom display of advertising. Criteo is a service of Criteo SA, 32 Rue Blanche, 75009 Paris, hereinafter referred to as “Criteo”. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our site.
Information about your visit to our website and your activities on the websites of our advertising partners is collected via tracking cookies and similar storage techniques.
